Terms and Conditions

PREAMBLE

For the purposes of these Terms and Conditions, it is agreed that the User and Lililamp will be collectively referred to as the “Parties” and individually referred to as the “Party” and that the User who has validated an order will be referred to as the “Buyer”. The rights and obligations of the User necessarily apply to the Buyer.
The User who wishes to purchase on the site declares that he/she is over 18 years of age and has full legal capacity or has the authorisation of a person with parental authority, a guardian or a curator.
Any order of a Product offered on the site implies the consultation and express acceptance of these General Terms and Conditions of Sale, without this acceptance being conditional on a handwritten signature by the User.
These Terms and Conditions apply, without restriction or reserve, to all sales made by Lililamp to non-professional buyers who wish to purchase the products offered for sale by the Seller on its websites mentioned above.
These General Terms and Conditions of Sale are accessible at all times on these websites and will prevail, if necessary, over any other version or any other contradictory document.
In the absence of proof to the contrary, the data recorded by Lililamp constitutes the proof of all transactions. In accordance with the legal provisions, it is reminded that the validation of an order is done by clicking on the “BUY” button. This validation constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature and is proof of the completeness of the order and the payability of the sums due in execution of said order. In any case, the online provision of the credit card number and the final validation of the order will be considered as proof of the completeness of the said order in accordance with the provisions of the law of March 13, 2000 and will be considered as proof of the payability of the sums engaged by the seizure of the articles appearing on the order form.
Access to the Lililamp website is made under normal Internet connection conditions. The User will not be charged any additional connection costs. These General Terms and Conditions of Sale may be subject to change. The conditions applicable are those in force on the date your order is placed. The editing and saving of these conditions are the responsibility of the Buyer.

Art. 1. Object

The purpose of these General Terms and Conditions of Sale is to define, exclusively for the relations that the Parties establish on the Internet, their respective rights and obligations arising from the online sale of the products offered on the site. These conditions regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the Contracting Parties. The Parties agree that their relations shall be governed exclusively by this contract. If a condition is missing, it will be considered to be governed by the practices in force in the distance selling sector whose companies are based in ES.

Art. 2. PRODUCTS-PRICES

The prices are indicated in euros, taking into account any discounts and the VAT applicable on the day of the order. The prices indicated are guaranteed within the limits of available stocks, except in the event of significant changes in charges, including VAT, and except in the event of typographical errors or omissions. The prices indicated do not take into account the shipping costs which will be charged in addition and will be specified to the User during the final validation of his order.
Lililamp reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time the order is registered, subject to the availability of the Products. When an order is validated and contains one or more erroneous elements (price, description, photo, coupon, etc.), Lililamp reserves the right to cancel the order and to reimburse the customer.

2.1 PRICE

The price indicated in the description of each item is purely indicative and corresponds to an estimate by Lililamp’s supplier of the average selling price of the item in its traditional distribution network at the date of sale.

Art. 3. REGISTRATION AND VALIDATION OF THE ORDER

3.1 NAVIGATION INSIDE THE SITE

The User can view the various Products offered for sale by Lililamp on its website. The User can freely browse the different pages of the site, without being committed to an order.

3.2 REGISTRATION AND PASSWORD

Registration is necessary and mandatory to place an order. The User must accurately fill in the information requested and required on the “My Account” page as well as on the sub-pages of the “My Information” section. The User will have to fill in the information necessary to identify him/her and in particular, his/her first and last names, postal address, e-mail and password.


Lililamp guarantees the confidentiality of the data transmitted after the password has been entered. The User is responsible for the use of his/her password. The User is responsible for keeping the password safe and confidential. If the User loses his/her password, he/she should contact Lililamp as soon as possible to obtain a new password.


If the User forgets his/her password, he/she can obtain a new one by clicking on the “Forgotten password” link on the home page and a form will be sent to him/her by e-mail to create a new password. When creating an account, the User can authorize Lililamp to send him/her invitations to sales and announcements from the Lililamp Team by email.

3.3 REGISTERING AN ORDER

3.3 PLACING AN ORDER
The User places an order via an Internet connection enabling him/her to browse the site. In order to be accepted, the order must contain all the useful and necessary information for its processing. Furthermore, any order implies acceptance of the General Terms and Conditions of Sale, the prices and description of the products available for sale.
If the User wishes to place an order, he/she shall select the various products that interest him/her and express his/her interest by clicking on – – the “Add to basket” box.
– At any time, the User may:
– Obtain a summary of the Products they have selected, by clicking on “My basket”.
– Continue their selection of Products by clicking on “Continue shopping
– Complete their selection of Products and order the Products by clicking on “Buy”.
To order the Products selected in the shopping cart, the User must identify himself, either by entering his email and password if he has already created an account with Lililamp, or by filling in the “Register” form if he has not. The User is informed and accepts that entering these two identifiers to access his/her customer account (email address and password) confirms his/her consent.
Once the User has been identified, he/she must validate the delivery address and an order summary will appear on the screen, specifying: the nature, quantity and price of the Product(s) selected by the User, as well as the amount of the delivery costs, the total of the order, the User’s contact details and the delivery address.

3.4 FINAL VALIDATION OF THE ORDER

After having read the details of the future order, and once all the information requested has been completed by the User, the latter may click on “Pay the order” to definitively confirm the order.


In the case of payment by credit card, the User must provide certain information relating to the credit card used:

  • The name of the credit card holder,
  • The credit card number,
  • The expiry date of this one,
  • Its cryptogram number (3-digit number on the back of the credit card).

It is specified that with immediate payment by credit card or bank transfer, the means of payment offered by Lililamp on its website, the User will make his payment via the Lililamp website using the Eftpos terminal system. The Lililamp website is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data related to payment methods as effectively as possible. Thus, the User’s bank details are transmitted to the bank, which is itself secured by S.S.L. encryption, and at no time will the User’s bank details be transmitted to Lililamp’s computer system. Lililamp is therefore not responsible for this.


The User can save his/her bank details so that he/she does not have to enter them each time he/she places an order. As soon as the User validates his/her payment by credit card or bank transfer, the order is recorded and becomes irrevocable. The User becomes a Buyer. The order form will be recorded on Lililamp’s computer registers, which are themselves kept on a reliable and durable medium, and will be considered as proof of the contractual relations between the Parties.

3.5 CONFIRMATION OF THE ORDER

Once the Buyer has validated his/her payment by credit card (with the provision of his/her card number, expiry date and cryptogram) or bank transfer, a summary of the Buyer’s order will be sent by e-mail, upon receipt of the order form, to the e-mail address indicated by the Buyer at the time of the order. This confirmation will include all the elements of the contract between the Parties, as well as an estimate of the shipping date.


Lililamp recommends that the Buyer keep the order confirmation email or print it. However, documents archived in Lililamp’s computer systems will be considered as legal proof. A summary of the order will also be displayed in the customer account.

3.6 RIGHT OF WITHDRAWAL

In the event that you refuse delivery of your order to your door, our terms and conditions of sale will apply and the delivery and return costs will be deducted from any potential refund request. If you decide to cancel your delivery once the goods have been dispatched from the warehouse, the relevant costs will be deducted from any refund claim.

Art. 4. COUPONS AND SPONSORSHIP

4.1 ISSUANCE OF COUPONS

Coupons are materialized by a code that will be entered or has already been assigned to the customer account. A code may be sent by e-mail or post during special operations or the customer will be informed by e-mail of the allocation of a coupon in his customer account.

4.2 TERMS OF USE OF COUPONS

Only one coupon may be used on a single order. Under no circumstances may it be converted into currency. The coupons issued have an expiry date that cannot be changed. No new coupon may be issued or allocated to a User to replace an expired and unused coupon.


The application of a coupon necessarily implies that the value of the basket (before the calculation of shipping costs) is higher than the value of the coupon, except in the case where the particular conditions of use of the said coupon specify a minimum purchase amount (before the calculation of shipping costs). In this case, the value of the basket (before the calculation of shipping costs) must be higher than the value of the minimum purchase required to use the coupon.


A Buyer may not ask Lililamp to deduct the value of a coupon from an order that has already been validated and paid for, if the coupon code was not entered, selected or was defective when the order was placed.

4.3 USE OF COUPONS

In order to benefit from the discount associated with a coupon, the User will have to enter or select the coupon code which he will find in the drop-down menu of his basket, and provided for this purpose. After entering the coupon, the User must click on the “Ok” button. The discount will be immediately deducted from the amount of the order.

4.4 REFUND OF AN ORDER CONTAINING A COUPON

When an order contains a coupon, the amount of the coupon is distributed over all the items in the order in proportion to their respective value. The refund of a product in an order, for whatever reason, is made after deduction of the associated coupon.

Art. 5. PAYMENT

5.1 ORDER AMOUNT

The amount due by the Purchaser is indicated before the validation of the order by the User as well as on the order confirmation sent by e-mail by Lililamp to the Purchaser.

5.2 METHODS OF PAYMENT

Payment will only be made on the Internet by credit card (Blue, Visa, Eurocard/Mastercard) and bank transfer.

5.3 CONFIRMATION OF PAYMENT

The order will be considered valid after confirmation of the bank payment agreement. In case of refusal by the bank, the order will be automatically cancelled. In any event, Lililamp reserves the right to refuse any order or delivery in the event of a dispute with the Purchaser, total non-payment or partial payment of a previous order by the Purchaser, refusal to authorize payment by credit card from banking institutions. ClickLamp may not be held liable in the event of a dispute.

5.4 PAYMENT PERIOD

When the Purchaser pays with an immediate debit card, the Purchaser’s bank account is debited within 2 to 5 days of placing the order. This period varies according to the banking institutions.

In the case of a deferred debit card, the Purchaser’s bank account will be debited with the amount of his order under the same conditions as the usual debits.

5.5 EXCEPTIONAL CONDITION

Lililamp has implemented a verification procedure to prevent any fraudulent use of bank details to place an order on the Site. As part of this verification, the customer may be asked to send Lililamp (by fax, mail or email) a copy of both sides of his identity document and a proof of residence less than 3 months old. The order can only be shipped after receipt of the verification of the sent documents. Lililamp reserves the right to refund the said order in the event of non-receipt of documents or in the event of receipt of non-conforming documents.

Only customers who have placed an order for an amount greater than an amount defined by Lililamp will be required to provide these supporting documents. Following the registration of their order, the concerned Purchaser will receive an email from Lililamp Customer Service.

Art. 6. MAKING AVAILABLE

6.1 RECEPTION NOT CONFORMING

Upon receipt of your order at the exit of our warehouses, it is essential to check the condition and conformity of the products received.

If you have any complaints to make, please write on the receipt form all the reservations and observations you consider useful, in particular concerning damage (specify if the packaging is damaged: torn protective film, damaged packaging…), and refuse to accept it. Do not sign under pressure from the service provider. If he does not agree, specify the reason on the pick-up order: “the service provider did not wish to be present at the unpacking during the inspection of the package”. This is your right and only means of dispute in case of damage. The words “subject to unpacking” have no legal value.

Any anomaly concerning the product (missing, broken, non-compliant Product or damaged packaging) must be notified, within 24 hours of collection of the package, to Lililamp Customer Service at the following address: Contact. Any claim made after this period will be rejected and Lililamp will be released from any liability.

In the event that the Purchaser has not been able to recover his package, it will be kept at Lililamp warehouses. Lililamp will then offer the Buyer to make his order available to him a second time in the United Kingdom and charging the cost of the second availability.

The latter procedure also applies to packages returned by your Carrier following an incorrect delivery address or an unknown recipient.

Art. 7. RIGHT OF WITHDRAWAL AND RETURNS

7.1 SATISFIED OR REFUNDED

If you are not satisfied with the items received, you have a period of fourteen (14) days from the date of receipt of your order to return them in their original condition suitable for resale.

Before returning your products to us, please log into your customer account, click on “MY ACCOUNT / RETURNS / NEW RETURN” and select the items you wish to return to us.

Products must be returned:

  • in their original packaging and packaging to the address provided by Customer Service.
  • in new condition and suitable for resale.
  • with all their accessories.

In order to ensure a quick processing of your return, remember to insert in your package the return email that will be sent to you by Customer Service. If you do not have a printer, please write your order number, return authorization number and the codes of the products to be returned on plain paper.

7.2 REFUNDS

Lililamp.com will refund you within a maximum of 72 working hours from the date of receipt by LiliLamp.com of the package in its original condition. An email confirming the refund will then be sent to you. We will make the credit via the payment method you used when you paid for your order.

ORDER CONTAINING A DISCOUNT CODE

When an order contains a coupon (or discount code), the amount of the coupon is allocated to all items in the order in proportion to their respective values. The refund of a product of an order, for whatever reason, is made after deduction of the portion of the associated coupon.

7.3 DELIVERY NOT CONFORMING

You have received a defective item or an item that does not correspond to what you ordered: we are sincerely sorry.

You have a period of 24 working hours following receipt of your order to contact our Customer Service and inform us of this situation.

We recommend the following checks to check if your order is incomplete :

  • Make sure that your item has been ordered by checking your order confirmation email or by referring to the details of your order displayed in the “My Account/My Orders” section.
  • Consult the delivery note attached to your package. If the quantity shipped does not match the quantity ordered, the item can be :
    • shipped in another package that you will receive shortly
    • unavailable, the refund will be made within the next 72 hours
    • cancelled since you requested it

Check again the reference of your missing item on your delivery note. If the quantity shipped does not match the quantity ordered, please contact our Customer Service.

Upon delivery, the buyer or a third party designated by him will check the packages and products received. He will check the number of packages and products delivered, check the condition of the packaging and inspect the products to detect any damage, defect or non-conformity.

In the event of a claim, the buyer will have 24 hours (not including public holidays) to contact the shipping company that made the delivery and inform them of the problem encountered.

If his request is not admissible, the buyer shall specify precisely on the delivery note any damage, defect, missing or non-conformity that he has noticed, knowing that “subject to unpacking” has no value.

The buyer will confirm his reservations by registered letter with acknowledgement of receipt to Lililamp’s customer service at the following address:

The buyer will be able to justify any claim he has made and to allow Lililamp to have at its disposal the supporting documents that may be necessary to resolve this claim.

In the event of acceptance of a claim, Lililamp will exchange or refund the product within 72 hours (working days) (via the payment method you used when making the payment) if the product reference is no longer available.

The buyer will return the product to the carrier designated by Lililamp in its original condition and packaging and with all its accessories, if any.

Following repeated customer abuses, the company will no longer accept any “non-compliant product” returns that do not comply with its conditions.

Art. 8. COMPUTER SCIENCE AND FREEDOMS

8.1 NOMINATIVE INFORMATION

The provision of personal information collected in the context of distance selling is mandatory, as this information is necessary for the registration, processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential. The lack of information implies the automatic rejection of the order.

In accordance with the law n°78-17 of 6 January 1978 relating to data processing, files and freedoms, the processing of personal information collected on the Site has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL Declaration).

The User has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, the User must send a letter to Lililamp Customer Service (address above). In any event, the User shall ensure that he/she reminds his/her surname, first name, address and, where applicable, his/her Purchaser number.

Finally, Lililamp may communicate personal information to its business partners. The User may thus receive commercial offers from third parties. In this respect, it is specified that unless the User expressly refuses, his postal details may be communicated to Lililamp’s commercial partners. However, as far as his e-mail address is concerned, it may only be communicated to the said partners with the express consent of the User. Of course, the User retains the possibility of refusing such communication, either by not giving his consent when registering and/or validating his order, or by subsequently indicating his refusal by post, in accordance with the paragraph above.

8.2 COOKIES

The only cookies that Lililamp creates are those in the session that will be deleted when you log out of the site.

8.3 WEB BEACONS

Some web pages of the Site may sometimes contain electronic images or “web beacons”, which allow the number of visitors to the page to be counted.

These web beacons can be used with some of our partners, in particular to measure and improve the effectiveness of certain advertisements. In any case, the information obtained via these tags is strictly anonymous and simply makes it possible to collect statistics on the use of certain pages of the Site, in order to better serve the Users of our Site.

Art. 9. WARRANTIES AND RESPONSIBILITIES

9.1 PRODUCT INFORMATION

For each item sold on the Site, Lililamp undertakes to provide a descriptive sheet to present its essential characteristics, within the limits of the information provided by suppliers. Lililamp makes every effort to provide the User with as much information as possible to know the products before placing their orders.

Despite all the care taken in writing these descriptions, an error could occur. If the User notices an inconsistency, he/she may contact Customer Service to inform them.

Lililamp then undertakes to correct these errors as soon as possible. The photographs as well as the descriptions of the products are not contractual and Lililamp cannot be held responsible for any errors that may exist.

In particular, the images and colours of the products displayed on the site may not be exactly accurate to the actual colours of the items due to the effect of the Internet browser used and the resolution of the User’s screen (non-contractual photos and descriptions).

Lililamp sells top quality products. However, some items sold have “vintage” effects and include deliberate damage intended by the manufacturer (holes, discolorations, whiskers, permanent folds, etc.). These articles have been treated with the aim of giving them a particular aspect. The details added to the fabric are often made by hand. It is therefore impossible to ensure homogeneity of the articles. Thus, it is normal to notice differences between the article photographed and the delivered article.

9.2 PRODUCT WARRANTIES

The warranties of the products sold are indicated on the descriptive sheet. The Purchaser with a defective item, whose warranty is still applicable, must contact Lililamp Customer Service who will forward the procedures to be followed in order to obtain a repair, replacement or refund. Customer Service may request the Purchaser to contact the supplier directly. Lililamp will make its best efforts to provide the Purchaser with the supplier’s after-sales service details.

The warranties of the products sold are indicated on the descriptive sheet. The Purchaser with a defective item, whose warranty is still applicable, must contact Lililamp Customer Service who will forward the procedures to be followed in order to obtain a repair, replacement or refund. Customer Service may request the Purchaser to contact the supplier directly. Lililamp will make its best efforts to provide the Purchaser with the supplier’s after-sales service details.

9.3 RESPONSIBILITY

Lililamp’s liability is limited to the amount of the Buyer’s order. Lililamp’s involvement cannot be held responsible for any inconvenience or damage inherent in the use of a computer, a computer network or the Internet. In particular, lililamp cannot under any circumstances be held responsible for a service interruption, an external intrusion or the presence of a computer virus. Lililamp has only an obligation of means for all stages of access to the site, including consultation, filling in forms, placing orders, payment and any other service available on the Lililamp website.

Lililamp cannot be held responsible for any material, immaterial or physical damage caused by the malfunction or misuse of an item purchased on the Website.

It is the User’s responsibility to check with the local authorities for specificities regarding taxes, declarations, prohibitions, import or use possibilities of the ordered products. Lililamp cannot be held liable in the event of non-compliance with the legislation of the country where the products will be delivered.

Art. 10. PARTIAL DISABILITY

In the event that one of the clauses of this contract is null and void by a change in legislation, regulation or court decision, this shall in no way affect the validity of and compliance with these general terms and conditions of sale.

Art. 11. Intellectual Property

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of Lililamp. The user who has a personal website and who wishes to place, for personal use, on his website a simple link referring directly to the home page of the Site, must request authorization from Lililamp. However, any hypertext link referring to the Site and using the framing or in-line linking technique is strictly prohibited. In any case, any link, even tacitly authorized, must be removed at the request of Lililamp. Hypertext links may lead to sites other than the Site. Lililamp declines all responsibility in the event that the content of these sites contravenes the laws and regulations in force.

Art. 12. ENTIRE AGREEMENT

These general terms and conditions of sale and the order summary sent to the Purchaser form a contractual whole and constitute the entire contractual relationship between the Parties.

Art. 13. DURATION

These conditions apply throughout the duration of the online availability of the Products offered by Lililamp.

Art. 14. MAJOR STRENGTH

Lililamp’s shall not be liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of a disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood, fire.

Events meeting the criteria set by the case law of the Court of Cassation will be considered as force majeure. In the event of an event constituting force majeure, Lililamp will notify the User/Purchaser within five (5) business days of the occurrence or threat of such event.

The Parties agree that they shall consult each other as soon as possible in order to determine together the terms of execution of the order during the duration of the force majeure event.

Beyond a period of one (1) month of interruption due to force majeure, Lililamp may not honour the order, on the condition that it reimburse the Purchaser if necessary.

Art. 15. LEGAL NOTICE

Pursuant to Articles 6.III.1° and 19 of Law No. 2004-575 of 21 June 2004 on confidence in the digital economy, Users of the Site are informed of the following information :
